2. Eligibility and Website Use
By using our website, you agree to provide accurate information when placing an order and to use our website for lawful purposes.
You must not misuse our website, attempt unauthorised access, interfere with its operation, or submit fraudulent orders.
We reserve the right to investigate suspected fraudulent activity and take appropriate action in accordance with applicable law.
3. Products and Product Information
Sabarbers aims to ensure that all product descriptions, photographs, specifications and prices are accurate and up to date.
Product images are provided to illustrate the products. Minor differences in colour or appearance may occur due to lighting, photography or screen settings, but products supplied must still comply with their descriptions and applicable legal requirements.
Customers are encouraged to review product specifications, included accessories, charging requirements and operating instructions before purchasing.
We do not guarantee product features or performance beyond what is expressly represented or required by law.
4. Prices and Payments
All prices will be displayed in South African rand (ZAR), unless otherwise stated.
The total price payable, including applicable delivery charges and other mandatory fees, will be disclosed before the customer completes an order.
Payment must be completed through the payment methods made available at checkout.
Orders may be subject to payment verification. If payment is unsuccessful, we may be unable to process the order.
If a pricing or listing error occurs, we will take reasonable steps to notify affected customers and resolve the matter fairly and lawfully. Nothing in this clause removes any rights the customer may have under South African law.
5. Orders and Order Acceptance
Placing an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been dispatched.
We reserve the right to contact customers to verify order details, address suspected fraud or resolve stock and payment issues.
If we cannot fulfil an order, we will notify the customer and arrange any refund required by law.
Before finalising an order, customers should have an opportunity to review their selections, correct errors and withdraw from the transaction.
6. Shipping and Delivery
Sabarbers aims to dispatch and deliver orders within the estimated timeframes displayed on the website or communicated to the customer.
Delivery estimates are not guarantees unless expressly stated as such.
Customers must provide a complete and accurate delivery address and contact details. Delays caused by incorrect information may affect delivery.
If a product is unavailable or delivery cannot take place within the legally applicable or agreed period, we will notify the customer and provide the options available under applicable law.
Nothing in this section excludes a customer's legal remedies for late, incomplete or non-delivery.
7. Returns, Refunds and Exchanges
All returns, refunds and exchanges are subject to our separate Return & Refund Policy, which forms part of these Terms & Conditions.
South African consumer protection laws may provide customers with rights relating to defective goods, qualifying online purchases and other circumstances.
Where the Consumer Protection Act applies, qualifying defective goods may generally be returned within six months of delivery for a repair, replacement or refund, at the consumer's direction, subject to the Act.
The Electronic Communications and Transactions Act also provides a seven-day cooling-off right for qualifying electronic transactions, subject to its exceptions.
Customers should consult our Return & Refund Policy for the process to follow.
Nothing in our policies limits rights that cannot lawfully be excluded.
8. Product Quality and Warranties
Sabarbers is committed to supplying products that meet the applicable standards of quality, safety and performance.
Where applicable, the Consumer Protection Act provides an implied warranty of quality and other statutory protections.
Any manufacturer's warranty or additional commercial guarantee will be communicated to the customer where applicable. Such a warranty does not replace or reduce the customer's statutory rights.
Customers should follow the manufacturer's safety, cleaning, charging, maintenance and operating instructions.
Damage caused by misuse or unauthorised modification may affect a claim to the extent permitted by law, but will not automatically remove any statutory rights.
9. Cancellations
Customers who wish to cancel an order should contact Sabarbers as soon as possible.
Cancellation may not be possible once an order has been dispatched, but customers may still have rights under applicable consumer protection laws.
Any legally applicable cooling-off period, cancellation right or refund entitlement will be honoured.
10. Intellectual Property
Unless otherwise indicated, the Sabarbers name, logo, website design, original written content and other original brand materials are owned by or licensed to Sabarbers.
These materials may not be copied, reproduced, distributed or used commercially without permission, except where permitted by law.
Product names, trademarks and images belonging to third parties remain the property of their respective owners.
11. Privacy and Personal Information
Sabarbers collects and processes personal information as reasonably necessary to operate the store, process payments, fulfil orders, communicate with customers and provide customer support.
Personal information will be handled in accordance with applicable privacy laws, including POPIA, and our separate Privacy Policy.
We may share necessary information with service providers, including payment processors, delivery companies and website service providers, where appropriate and lawful.
We will take reasonable steps to protect personal information and will not use it for unrelated purposes without an appropriate lawful basis.
Customers may exercise applicable rights concerning their personal information through the contact details provided on our website.
12. Limitation of Liability
To the extent permitted by South African law, Sabarbers will not be liable for losses arising from circumstances beyond our reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable consumer rights, statutory warranties and liability that cannot lawfully be excluded.
Customers should use hair clippers in accordance with the supplied instructions and appropriate safety precautions.
13. Third-Party Services and Links
Our website may use or link to third-party services, including payment gateways, delivery providers and external websites.
These services may operate under their own terms and privacy policies.
Sabarbers does not control every aspect of third-party services, but this does not remove any responsibility or obligation that applicable law places on us.
14. Complaints and Dispute Resolution
Customers are encouraged to contact Sabarbers first if they have a concern regarding an order, product, delivery or refund.
We will make reasonable efforts to investigate complaints and resolve them fairly.
Where a dispute cannot be resolved directly, customers may pursue any remedies available through the appropriate South African consumer protection authority, ombud scheme or court.
Nothing in these terms prevents a customer from exercising a lawful right to submit a complaint.
15. Changes to These Terms
We may update these Terms & Conditions when necessary to reflect changes to our business, products, website or legal obligations.
The latest version and its effective date will be published on our website.
Changes will not retrospectively remove rights that customers have already acquired under applicable law.
16. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law, including any mandatory consumer protection provisions.
